Mr. Livingston said county fiscal courts are committed to working with county clerks on all projects including elections, record retentions, and other services provided by the office. Modernization of records will take time, and fiscal courts may have to find additional pools of resources to fund the remaining cost of the project. Lastly, the county clerk is the caretaker of the records as defined in statute.

Chairman Meredith commented on understanding the importance of excess fees to county budgets. He said any real action will revolve around the permanent storage fee in the near term. There was a bill filed in the 21RS of the General Assembly that established this fee to help cover the costs of county clerk office modernization efforts, and would not be subject to the excess fee rules. Mr. Livingston said the permanent storage fee is not going to cover the cost of digitizing the records and other funds will have to be provided through the fiscal court. If so, they would like oversight on the fees that should be going to the modernization as well.

Said county governing bodies may need additional resources to digitize county clerk records and sought oversight of fees intended for modernization.

“There were a lot of times when she had to take paper packets out to her students because the kids didn’t have access,” Livingston said. “Being able to provide that to them will be absolutely amazing. “We are going to increase our speeds within the city,” Livingston added, “and I’m very grateful for everyone that’s at the table because it takes one big team. - Magistrates, sometimes called justices of the peace, sit on the fiscal court, which serves as the county legislature and makes laws for the county.
- They decide how money is spent and raised by the county, including taxes, bonds, and property transactions.
- They oversee county infrastructure like roads, manage county property, conduct building inspections, issue permits, and operate the county jail.
- Each county features 3 to 8 districts, each electing 1 magistrate.
- Magistrates are elected for 4-year terms in partisan elections. Their salary caps at approximately $93,000 for full-time work, adjusted based on hours worked. The fiscal court determines this salary.
