Ethics & Conduct

In 2007, Huss was charged with second-degree rape, first-degree kidnapping, and second-degree sexual offense involving an ex-girlfriend. Despite maintaining his innocence and stating he had a video of the encounter proving he did not assault her, he was found guilty by a Lincoln County jury in July 2011 and sentenced to 12.5 to 15 years in prison.

Huss spent two and a half years in prison before the N.C. Court of Appeals unanimously reversed his convictions in November 2012, citing "insufficient evidence" (specifically ruling the prosecution failed to prove the victim was "physically helpless"). The state appealed the reversal, but the N.C. Supreme Court upheld the Appellate Court's decision. Huss was officially freed in December 2013.
